By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to FlowMD.

FlowMD is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The FlowMD app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the FlowMD app won’t work properly or at all.

You should be aware that there are certain things that FlowMD will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but FlowMD cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, FlowMD cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, FlowMD cannot accept responsibility.

With respect to FlowMD’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. FlowMD accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android – the requirements for the system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. FlowMD does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

NO MEDICAL ADVICE

You understand and agree that the Services, Products and any other information you learn from FlowMD are not intended, designed, or implied to diagnose, prevent, or treat any condition or disease, to ascertain the state of your health, or to be a substitute for professional medical care.  Not all activities described on the Services or Products are suitable for everyone. Do not use the Services while driving, operating heavy machinery, or performing other tasks that require attention and concentration. You understand and agree that you are solely responsible for your use of the Services.

FlowMD is a provider of online and mobile content in the health & wellness space. We are not a health care or medical device provider, nor should our Products be considered medical advice. Only your physician or other health care provider can do that. FlowMD makes no claims, representations or guarantees that the Products provide a therapeutic benefit.

Any health information and links on the Products, whether provided by FlowMD or by contract from outside providers, is provided simply for your convenience.

Any advice or other materials in the Products are intended for general information purposes only. They are not intended to be relied upon and are not a substitute for professional medical advice based on your individual condition and circumstances. The advice and other materials we make available are intended to support the relationship between you and your health care providers and not replace it. We are not liable or responsible for any consequences of your having read or been told about such advice or other materials as you assume full responsibility for your decisions and actions. In particular, to the fullest extent permitted by law, we make no representation or warranties about the accuracy, completeness, or suitability for any purpose of the advice, other materials and information published as part of the Products.

People with existing mental health conditions should speak with their health care providers before using FlowMD Products.

DISPUTE RESOLUTION / EQUITABLE RELIEF

In the event of any dispute arising out of this Agreement, the parties shall make commercially reasonable efforts to negotiate a settlement in good faith. If they do not reach a resolution within sixty (60) days (or a longer period if mutually agreed), either party may refer the dispute for settlement by arbitration before a single arbitrator, in accordance with the Arbitration Rules of the Israel Institute of Commercial Arbitration. The arbitration will be conducted in Tel Aviv, Israel, and the proceedings shall be governed by the laws of the State of Israel. The costs of the arbitrator will be shared equally by the parties, while each party shall bear its own legal expenses.

The arbitrator shall be selected promptly, and the arbitration hearing should take place no later than three (3) months after the arbitrator is appointed. The arbitrator shall not award punitive or exemplary damages, and any relief granted shall not exceed the limitations set forth in this Agreement. The arbitrator’s decision shall be final and binding. Either party may seek enforcement of the arbitration award in any competent Israeli court. No claim arising from these Terms may be brought more than twelve (12) months after the event giving rise to the claim.

Equitable Relief
You acknowledge that any breach of these Terms may cause irreparable harm to FlowMD, which may not be adequately remedied by monetary damages alone. Therefore, FlowMD shall have the right to seek injunctive relief or other equitable remedies in Israeli courts to enforce its rights under this Agreement without the need to prove actual damages. This right is in addition to any other legal remedies available under Israeli law.

You are eligible for a full reimbursement within 3 calendar days of your purchase. After the 3-day period you will no longer be eligible and won’t be able to receive a refund.
